Acceptable Use Policy

1. Purpose

This Acceptable Use Policy (“AUP”) governs your use of the Lead Distro AI platform (“Service”) operated by Great Marketing AI Inc.. It is incorporated by reference into our Terms of Service. Violating this AUP is a breach of the Terms and may result in immediate suspension or termination of your account, without refund.

2. Lawful Use Required

You must comply with all applicable laws when using the Service. You are solely responsible for your use of the Service and for any data you submit, distribute, or call. This includes:

• The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and its implementing regulations under 47 C.F.R. § 64.1200
• The Federal Telemarketing Sales Rule (TSR), 16 C.F.R. Part 310
• The CAN-SPAM Act and applicable state anti-spam laws
• State mini-TCPA statutes including the Florida Telephone Solicitation Act, Oklahoma Telephone Solicitation Act, and Washington RCW 80.36.400
• The California Consumer Privacy Act (CCPA / CPRA), GDPR, and other applicable privacy laws
• Federal and state Do Not Call registries and any internal company-specific DNC lists
• Industry-specific rules (HIPAA for health data, GLBA for financial data, FCRA for credit data)

3. TCPA-Specific Requirements

You represent and warrant that for every consumer phone number you submit to or distribute through the Service, you have obtained the appropriate level of consent under the TCPA — at minimum, prior express consent for informational calls, and prior express written consent for marketing calls and texts placed using an autodialer or pre-recorded voice.

You agree that you will:

• Maintain documented proof of consent for at least four (4) years for every consumer record
• Honor opt-out and revocation requests within ten (10) business days
• Scrub all outbound contact lists against the federal DNC registry and any state DNC registries that apply to you
• Not use the Service to contact numbers on any internal DNC list, suppression list, or litigator/honeypot list
• Identify yourself, the entity on whose behalf the call is made, and the purpose of the call at the start of every outbound call
• Not call residential numbers outside the hours of 8:00 AM to 9:00 PM in the called party's local time zone

For AI-generated voice calls placed through the Service, the AI assistant is configured to clearly identify itself as an artificial intelligence at the start of every call. You may not modify, suppress, or attempt to circumvent this disclosure.

4. Prohibited Uses

You may not use the Service to:

• Distribute or process leads obtained through deceptive, fraudulent, illegal, or unauthorized means
• Generate, distribute, or sell synthetic, scraped, recycled, or otherwise non-consensual leads
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Send spam, harass, threaten, defame, or stalk any consumer or third party
• Distribute leads for any of the following without our prior written approval: cannabis or CBD products in jurisdictions where they are unlawful, payday or short-term high-interest loans, adult content, firearms, gambling, cryptocurrency speculation, multi-level marketing, debt elimination services, or work-from-home schemes
• Resell, sublicense, lease, or otherwise make the Service available to third parties without our written consent
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Use the Service in a manner that could damage, disable, overburden, or impair our systems
• Probe, scan, or test the vulnerability of the Service or breach any security or authentication measures
• Circumvent rate limits, quotas, fair-use policies, or other access controls
• Upload or transmit malware, viruses, worms, trojans, or other harmful code
• Use the Service to violate the intellectual property, privacy, publicity, or other rights of any third party

5. Restricted Verticals

Lead generation and distribution for the following verticals is permitted only with prior written approval from us, due to elevated regulatory and litigation risk:

• Mass tort and class-action legal solicitation
• Healthcare lead generation involving Protected Health Information (PHI)
• Insurance final-expense and Medicare Advantage
• Consumer debt relief, credit repair, and debt settlement

6. Account Security

• You must protect API keys, webhook secrets, and login credentials and treat them as confidential
• You must not share your account or allow unauthorized access
• You must notify us within 24 hours of any suspected compromise at support@leaddistro.ai
• We may rotate or revoke any credential at any time if we suspect compromise or abuse

7. Enforcement

We may investigate any suspected violation of this AUP. Violations may result in any of the following, at our discretion and without notice:

• Warning and required remediation
• Throttling or temporary suspension of API access
• Removal of offending leads, campaigns, or content
• Permanent termination of your account, with no refund of fees paid
• Reporting to law enforcement, regulatory bodies, or affected third parties
• Civil action to recover damages, including attorney fees and costs

You agree to indemnify and hold us harmless from any claim, loss, fine, or expense (including reasonable attorneys' fees) arising from your violation of this AUP, your violation of any law, or your violation of the rights of any third party.

8. Reporting Abuse

To report suspected abuse of the Service, including TCPA violations, spam, harassment, fraud, or security incidents, contact us at support@leaddistro.ai. We investigate all reports and respond within five (5) business days.

9. Changes to This AUP

We may update this AUP from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised AUP.
